rancho-motorsports in temecula ca. had my two bikes for sale on consignment and closed the doors without contacting me now i dont know where my bikes are any help would be appreciated

Sounds like a job for Law Enforcement.

Wow, that sucks. Try and get a hold of RJ out at Perris Raceway. He lives in Temecula and is in touch with the community and the sport.

called the cops and they said they cant do anything about this situation.

do you have a contract with them for the consignment? If so they are in violation but you may need to go after them civily and not criminally. You should find out who the owner is/was and file papers immediately through either small claims or civil court demanding your bikes back. I would not waste time because the longer you wait the more red tape developes as creditors step in and start seizing assests or filing their claims. Often the payouts are in order of when they were filed and those that waste time get their portion of zero

how can this not be criminal? isnt it the same as stealing my bikes?

Posted by: BigRedAF---------------------

File a theft report. If you have homeowners insurance and the place of storage while waiting to be sold is less than a specified distance your insurance may pay you for your loss, just an other angle...

Moving thread to Flame Board.

It's not criminal to got out of business. If they have YOUR bikes locked up and refuse to release them then perhaps there is something criminal but at this point it would seem to be you just need to attempt to cover your butt. Several good suggestions above about hitting it from multiple angles, don't just get focused on the "theft" which may or may not have actually happened.

Ouch. There was a chopper dealer here in Joliet that did a similar deal. Didn't turn out well for anybody. You could google the name Bikers Dream Joliet and scare the crap out of yourself if you were so inclined.

Good luck, hopefully it'll work out for ya.

Posted by: J-man---------------------

wow that really sucks

Posted by: BigRedAF---------------------

The bikes are yours, you have the titles right? Now you just need to find them. If they're sold you will be able to get them back and the buyer will be have a case against the seller.

Posted by: Tim Duclos---------------------

yes the bikes are registered to me and i just hope i can find them. (dont ever sell anything on consignment!)

Posted by: Tim Duclos---------------------

i am going to file a claim with the courts and see where that gets me. it just bums me out that people get away with this kind of crap all i want to do is ride!!!!

Good idea to file or report. At least there will be a record if they show up later.

Try the RJ connection that I mentioned earlier. RJ is an easy going guy and might know the people that ran the shop since he lives in the same town. You can reach him at his track teaching riding schools.

i will try to get in touch with him thanks for the help.

Do not file against the business only be sure you file against the registerred owner as well. The business is gone but he isn't- yet

Posted by: jcarautos1---------------------

You could put a small claims hold on the property. When they sell the property you would either get your vehicles back or the amount they were worth at the time. But you need to lawyer up.

Posted by: Tim Duclos---------------------

well the latest in my motorcycle saga is i finally got my quad back (damaged of course but i have it) but they sold my 450 and never contacted me about the sale. They even went to the extent of saying i picked up the check and had a made up letter forging my signature which is clearly not my signature this is such a nightmare well time for court!!!

Posted by: BigRedAF---------------------

Perhaps the district attorney will prosecute them and you won't have to hire an attorney. If you do hire one it will cost way to much and from the sounds of it they don't have any money to repay you anyway...

With any luck the forgery will put them in jail!
