Sheltrown Seeks Public Comments on ORVs
PA 240 marks 1 year Anniversary
( LANSING ) State Representative Joel Sheltrown (D-West Branch) is seeking public comment about the results of county ordinances which have allowed ORVs to operate on the shoulders of many county road in northern Michigan . Friday, July 17 marks the one year anniversary of Public Act 240, sponsored by Sheltrown, which gives counties this authority. After Friday, townships will also be allowed to adopt their own ORV ordinances.
To date, 36 out of the 43 counties in the northern Lower Peninsula and Upper Peninsula have approved ordinances opening some or all of their county roads to ORVs. In addition, legislation has passed the House of Representatives to open four counties in the Thumb. New legislation is being drafted that would allow every county in the state to open its roads to ORVs if it chooses.
Joel Sheltrown has said that several counties have asked for amendments to be added to the new legislation to more adequately fund enforcement and better define where on the road ORVs should operate. Sheltrown also said that identification requirements will be added to more easily target trespassing on private property.
"Public Act 240 is working well. However, trespassing of ORVs on private property remains the most frequently mentioned concern, just as it was before the passage of Public Act 240," Sheltrown said. "In some counties, the increasing number of ORVs has resulted in more trespassing complaints. We are looking at ways to crack down on trespassers. And while accident rates have been far lower than what some people predicted, we want to maintain a great safety record. Parents, in particular, need to make sure younger riders are directly supervised and always wearing helmets."
